Terms of Service

These terms are a contract between you and Bartłomiej Żabicki, a sole proprietor established in Poland, operating as BartStudio (registered address ul. Podgórska 3, 32-010 Baranówka, Poland, NIP PL6821775165) — “we” in this document. They cover the CSCS Prep app for iPhone and iPad and the website at cscs.bartstudio.io.

By downloading or using the app you accept these terms. If you do not accept them, do not use the app. Our Privacy Policy explains what happens to your data and forms part of this agreement.

CSCS Prep is a revision aid: original practice questions, timed mock exams, behavioural case-study practice, safety-sign training and progress tracking, all built to help you prepare for the CSCS card health, safety and environment test.

It is equally important to be clear about what it is not:

• It is not official. CSCS Prep is independent and is not affiliated with, endorsed by, licensed by or connected to CITB, CSCS Ltd, any card scheme or any test provider. “CSCS” and “CITB” are trademarks of their respective owners, used here only to describe what the app helps you prepare for.
• Our questions are not real test questions. They are original practice material written to the publicly available syllabus outline. Real test content is confidential and we neither have it nor want it.
• Using the app does not book, replace or shortcut the real test. You book and sit that through the official test provider, under their rules.
• It is not workplace safety training. The app prepares you for an exam. On site, always follow the law, your employer's instructions, your site induction and the safety documentation for the work you are doing.

The readiness score, mock-exam results and every other number in the app are estimates built from your practice, offered to guide your revision. They are not a prediction, promise or guarantee that you will pass the real test, and we accept no liability for the outcome of any test, card application, job or contract. Exam content and formats change; we update the app in good faith but cannot promise it always mirrors the current test.

The core of the app — daily practice and Sign School — is free. A single one-time purchase unlocks everything else, permanently, for the Apple Account that bought it: unlimited mock exams, weak-spot review, the full case-study set and future additions to this app, unless we clearly mark something as a separate product.

• Billing is by Apple. The purchase happens through the App Store under Apple's terms; the price is shown in your local currency at checkout. We never see your payment details.
• It is not a subscription. Nothing renews, and there is nothing to cancel.
• Restoring: the unlock follows your Apple Account — use “Restore purchase” in the app's Settings on a new device.
• Refunds are decided by Apple under App Store policy — request one at reportaproblem.apple.com. Statutory consumer rights, including EU and UK withdrawal rights for digital content, are unaffected; note that under those rules the right of withdrawal lapses once you consent to immediate delivery of digital content.
• Prices may change for future buyers; a change never takes anything away from a purchase already made.

You agree not to:

• copy, scrape, extract or republish the question bank, case studies, explanations or any other content of the app, in bulk or in part, or use them to build or train a competing product;
• reverse-engineer, decompile or modify the app except where law permits;
• circumvent the purchase entitlement or help others do so;
• misrepresent the app as official CITB, CSCS or test-provider material, or use it to cheat in the real test in any way.

We grant you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, for your own revision. The app, its question bank, case studies, explanations, design and branding are our intellectual property and are protected by copyright.

Third-party trademarks — including CSCS and CITB — remain the property of their owners. Nothing in these terms grants you or us any right in them.

The app is distributed by Apple and uses your own iCloud for sync and RevenueCat for purchase entitlements, as described in the Privacy Policy. Apple's media services terms apply to the App Store purchase itself. We are not responsible for services we do not operate, including iCloud availability.

We may update, change or discontinue features to keep the app accurate, lawful and maintainable — including revising questions when syllabus guidance changes. The app works offline; nothing in it depends on a server of ours staying up. If we ever discontinue the app entirely, purchases already delivered remain usable on installed devices, and these terms keep applying to them.

The app and website are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the maximum extent permitted by law. In particular, we do not warrant that practice content is free of errors or that it matches the current content of any official test. Nothing in this section limits rights that consumer law gives you and does not let us exclude.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss — including a failed test, lost work, lost profits or lost data — arising from your use of the app.

Our total liability for all claims arising out of or relating to the app is limited to the greater of the amount you paid us in the twelve months before the claim and EUR 50.

Nothing in these terms excludes or limits liability that cannot be excluded by law, including for death or personal injury caused by negligence, or fraud. If you are a consumer, you keep every right your local consumer law gives you.

You can end this agreement at any time by deleting the app. We may suspend or terminate your licence if you materially breach these terms — for example, by scraping the question bank. Sections that by their nature should survive (intellectual property, disclaimers, liability, governing law) survive termination.

Because the app is distributed through Apple's App Store:

• These terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app.
• In case of a failure to conform to warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law Apple has no other warranty obligation.
• Apple is not responsible for addressing any claim relating to the app, including product-liability, regulatory or IP claims.
• You confirm you are not in a country under a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

These terms are governed by Polish law, and disputes go to the courts with jurisdiction over Kraków, Poland. If you are a consumer, this choice does not deprive you of the protection of the mandatory consumer laws of the country where you live, and you may also bring proceedings there. The European Commission's online dispute resolution platform is at ec.europa.eu/consumers/odr.

• If a provision of these terms is found unenforceable, the rest remain in force.
• Our not enforcing a provision is not a waiver of it.
• You may not assign this agreement; we may assign it as part of a transfer of the product, with your protections intact.
• These terms and the Privacy Policy are the entire agreement between us about the app.

This is version 1. When we change these terms materially we bump the version number and update the date above, and where appropriate we will tell you in the app. Your continued use after a change means you accept it; if you don't, stop using the app and delete it.
